Andreia Morgado Duarte analyses the challenges in obtaining Portuguese nationality

News

The process for obtaining Portuguese nationality has been marked by growing challenges, from procedural delays to different interpretations of current legislation.

In an opinion article for The Portugal News, Andreia Morgado Duarte, Senior Associate in CCA Law Firm’s Private Clients practice, analyses the challenges in obtaining Portuguese nationality. She emphasises that legislative complexity, procedural delays and recent interpretations by the Agency for Integration, Migration and Asylum (AIMA) pose significant obstacles for applicants, making the procedure more time-consuming and uncertain. Moreover, there is an urgent need for greater clarity in the application of the Nationality Act and in the definition of the time limits for legal residence.

"The consequence of such a complex and unstable legal system is clear: applicants for Portuguese nationality face increased difficulties in proving their length of legal residence, which can jeopardise their rights and expectations", explains the lawyer who works for CCA Law Firm.
