Catarina Limpo Serra, Coordinator of the CCA Litigation Department, in statements to Exame Informática, analyzes the controversy surrounding the public tender launched by the Agency for Administrative Modernization (AMA) for the development of an authentication system for the Digital Mobile Key (CMD), which works based on remote face recognition. Although it is a tender announced in Diário da República, AMA refuses to provide any data on the matter, invoking the legal framework in force.
"From what I understand, AMA should make available at least information on the number of competitors. It may also provide identification of the competing companies. In any case, the refusal to provide data must be legitimate and must always be substantiated, and may be based on, for example, Article 6 (3) of Law 26/2016", stresses the Coordinator.
