Cláudia Xara-Brasil, Industrial Property agent and consultant with CCA Law Firm, spoke to Jornal Económico, about the main limitations of Industrial Property in Portugal and how, from a legal point of view, IP should prepare for the next decade in our country.
"Although Portugal is at a very equidistant level of development and legislative progress when compared to most European countries, there is a long way to go, especially in terms of the coordination of legislative measures and the practical applicability of certain major legal institutions already legislated", underlines Cláudia Xara-Brasil; adding that "IP has a very important role and must be perceived as a tool allowing to restore or maintain the economic level of companies. The perception of intellectual property rights as a purely legal issue must be changed to be able to see them as an instrument of growth. It is necessary to stress the importance of these intangible assets in which Industrial Property is expressed".
Regarding the future, the CCA consultant stresses that "there is a need to ensure early information and education and quality strategic advice on IP management. In this sense, tools and systems need to be developed to update specialization and, as mentioned, special attention to SMEs. In addition, it is important to continue to include IP in debates on industrial policy so that intellectual property is not considered or treated in isolation. It is necessary to invest further efforts in EU projects and to put in place a system allowing the linking of inventors/creators, industry and public sector, in particular for key EU technologies".
