Cláudia Xara-Brasil, CCA's industrial property consultant, talks to Jornal Económico about the new Industrial Property Code.
The CCA’s consultant mentions that "in general terms, we could say that we currently have comprehensive and cross-cutting intellectual property legislation, in which there are no serious gaps. Legislation that can be said to protect the holder of the intellectual property rights and provides security for all concerned parties".
"The Intellectual Property Court has effectively ensured that intellectual property rights are upheld, and it is only necessary to mention the need for the creation of a court of appeal also specialized in IP matters, which in fact does not currently exist (although there is currently a project for its establishment), as currently appeals are made to the Court of Appeal which has no competence or specialized sections", clarifies Cláudia Xara-Brasil.
