Over the past few years, Portuguese youtubers and streamers have advertised, in exchange for commissions, illegal gambling sites with their subscribers, including minors and vulnerable people who have opted out of online gambling. They promote a luxurious lifestyle, but most of those who follow their financial advice end up losing hundreds of euros. Speaking to Observador, Filipe Mayer, Partner responsible for CCA's online gaming area, comments on the case of Youtuber Numeiro, accused of being involved in illicit schemes which promised his followers “easy profit”. It is also accused by these users of changing the odds and not issuing invoices and therefore evading taxes.
"The crime of fraud may be at stake here, if the person in question, with the intention of obtaining for himself (or for a third party) an illegitimate enrichment, by means of error or mistake on facts that he has cleverly caused, determines other people to acts that result in damage to them", explains Filipe Mayer, adding that "anyone who appears in the public space suggesting bets on illegal operators is nothing more than promoting unlicensed gambling and is, therefore, committing a crime".
When it comes to protecting minors and other groups at risk, the promotion of gambling has very strict rules, as the CCA Partner emphasizes, "the promotion of gambling must focus on the fun aspect of the activity, not underestimating non-players, not appealing to aspects related to the easy obtaining of a victory, not suggesting success, social success or special aptitudes as a result of the game, nor encouraging excessive gambling or betting practices".
