Whether due to suspicions of crimes or conflicts of interest, the Portuguese legal system protects the identity of whistleblowers, considering that the anonymity of a complaint does not detract from its importance or validity. However, this is not the case in all European countries. Speaking to Advocatus, Francisco Pimenta, Principal Associate in the Litigation & Arbitration practice at CCA Law Firm, explains how the law varies in Europe.
‘This is the most discussed topic in the implementation differences between the various Member States of the European Union. In countries such as Germany, the directive has been implemented without the possibility of anonymity for the whistleblower being required by the Whistleblower Protection Act, leaving it up to the relevant entities to put in place channels that allow them to report in this way or not’, explains the lawyer.
