As part of the “Operação Marquês” case, the Lisbon Court of Appeal (TRL) ruled on 25 January that former Prime Minister José Sócrates will be tried for passive corruption, almost entirely restoring the prosecution's indictment. Speaking to CMTV, Henrique Salinas, Partner at CCA Law Firm, commented on the TRL ruling, which repeals the April 2021 decision signed by Judge Ivo Rosa.
“Appeals exist because they take into account that a decision at first instance is not perfect, and therefore, in certain cases, it must be amended or even overturned by the higher court. Were this principle not the starting point, there would be no appeals in our legal system,” says the CCA partner.
