Henrique Salinas, CCA ONTIER's Criminal Area Partner, in statements to Advocatus-ECO, commented on whether the public interest may legitimize the disclosure, by the media, of José Sócrates and other defendants' interrogations videos in the context of Operation Marquês.
'The vague and generic invocation of 'public interest' is not enough to justify the disclosure of these images. Only in concrete circumstances duly invoked and proven in court can those responsible for the disclosure exclude their criminal liability, which will depend on whether they consider that they are subject to justification or exclusion of guilt, in this case, freedom of the press', says Henry Salinas.
