Inês de Oliveira Silva, associate of the CCA's Litigation and Arbitration Department, writes an opinion piece for Observador on the controversy surrounding the dissemination of private messages exchanged between international footballer João Félix and a Spanish doctor, Arancha Zur, on the social network Instagram. The messages were posted on the doctor's profile, allegedly to publicly denounce marital infidelity, considering that at the time the footballer was having a relationship with the actress and model Margarida Corceiro.
"Regardless of the basis or the morality of the justification presented, it is indisputable that these are messages exchanged within the most intimate sphere of the player" stresses Inês de Oliveira Silva. The lawyer also adds that "both our criminal law and our civil law provide for sanctions and responsibilities for those who, without consent and with the intention of invading the privacy of individuals, namely the intimacy of family or sexual life, harm this space and sphere of reserve. The truth is that none of the solutions has the capacity to restore all that social networks can cause because of their viral effect, being unable to prevent or even to minimize the spread of such illegal content".
