Joana Freitas Peixoto comments on the new concept of ‘municipal waste’

Did you know that at the beginning of this year, the Government made sweeping changes to the waste management framework (RGGR), the landfill of waste and the management of specific waste streams (UNILEX)?

These changes not only affect all waste producers and their waste treatment operators since, in addition to establishing new responsibilities and obligations for them, a significant change has also been made to the very concept of ‘municipal waste’.

In an article for Revista de Direito Local published by AEDREL, Joana Freitas Peixoto, Principal Associate in the Public Law department of CCA Law Firm, addresses these issues, stating that the amendment has led to a change in the scope of the concept, encompassing some types of waste that were not previously considered ‘municipal waste’.

‘This change should be taken into account by waste producers (...), but it is the (private) waste treatment operators who should be more attentive, as they may be receiving waste that is currently included in the public service reserve, which constitutes an administrative offence’, emphasises the CCA lawyer.
