Madalena de Azeredo Perdigão, Associate of the CCA Litigation and Arbitration Department, in statements to MAGG magazine, presents the legal framework of a teacher‘s aggression towards a student, explaining that the teacher may incur the crime of ill-treatment under the terms and for the purposes of Section 152.ºA of the Criminal Code.
"A teacher does not have the right to use corporal punishment on a student (...) the behavior of a teacher who physically harasses a student could never be considered as an educational purpose", emphasizes the lawyer.
