Maria Barbosa, Managing Associate of the Labour Department at CCA, wrote an opinion piece for the Human Resources magazine on the return to the face-to-face work and the doubts surrounding the rights of workers and companies.
According to the CCA lawyer "(...) except in very specific cases (such as work carried out in hospitals and nursing homes), the employer cannot ask its workers to present a vaccination certificate. Likewise, the employer cannot require its workers to be vaccinated, because the COVID-19 vaccine is not part of the National Vaccination Plan".
"In cases where teleworking is not compulsory, but only recommended, it is necessary that the employer and the worker sign a written telework agreement", adds Maria Barbosa.
