Martim Bouza Serrano comments on the lack of advice from the CNPD to expand epidemiological screening

Under the new State of Emergency, the Council of Ministers approved last Wednesday a measure that allows the processing of clinical data by people who are not health professionals, without requiring the consent of patients. This approval by the Executive arises, even though, at the date of publication of the decree-law, the National Commission for Data Protection (CNPD) has not issued its opinion. Speaking to Expresso, Martim Bouza Serrano, CCA's Partner and Managing Associate of Technology, Media and Telecommunications (TMT) Department, shares his opinion on the Government's obligation to consult with the entity that oversees privacy policies in Portugal, despite not being obliged to follow the advice of the CNPD.

"Although we understand the need to implement mechanisms to expand the resources needed to ensure adequate screening of patients with COVID-19, unfortunately, due to a clear lack of preparedness and planning, this strengthening must now be done at the sacrifice of security and privacy and without the minimum guarantees that our data will be protected", states CCA's Partner and TMT Managing Associate.
