Pedro Antunes explains anti-competitive agreements in the labour market

In recent years, the labour market in Portugal has come under increased scrutiny from the Portuguese Competition Authority (AdC), which has been imposing sanctions on companies involved in anti-competitive practices. These offences can have serious consequences for both employees and the functioning of the market.

In an opinion piece for RHmagazine by IIRH, Pedro Antunes, a partner in CCA's Labour department, explains that wage fixing and ‘no poach’ agreements - agreements between companies not to solicit or hire employees from competitors - are practices that undermine free competition.

These practices not only contravene the Competition Act, but also limit labour mobility and harm the economic environment and innovation.

‘The application of these restrictions on employees can have an extremely significant impact on the product-labour market, since not only are companies unable to compete for the best employees, but they are also unable to meet the demand for qualified labour,’ says the lawyer.
