Pedro Antunes, Partner and Coordinator of the Labour Department of CCA Law Firm CCA, was online in yet another edition of Rádio Renascença's program, “Em Nome da Lei”, in which he clarified the doubts of the listeners of the station in this time of state of emergency and crisis caused by the COVID-19 pandemic.
In response to a listener whose company has teleworking employees and employees working in normal conditions, Pedro Antunes explains that because they are at risk of potential contamination, given the possible exposure to the virus, workers who maintained their normal work situation are entitled to a risk subsidy "under the terms of the Decree-Law that implements the extension of the state of emergency, teleworking is obligatory whenever the functions of the worker allow it. If there are workers working normally since their functions do not allow teleworking, this does not imply the payment of a risk subsidy, or at least it is not provided for in the abovementioned Decree-Law, because the company has not voluntarily place itself in this situation, but is in it due to the circumstances. The company may and has the possibility of making this payment if it chooses so, however it is not an obligation".
