Pedro Antunes, CCA ONTIER's Labor Coordinator, spoke to Dinheiro Vivo about the entry into force of the law of the State Budget for 2018, which terminates the temporary regime that allowed the payment of subsidies in twelfths.
According to the lawyer, 'the rules governing the form and dates of payment of the holiday allowance do not prevent the employer and the worker from agreeing to the phased payment'. However, Pedro Antunes recalls that 'this decision must be expressed in a written agreement'.
With regard to the Christmas allowance, the conclusion is identical, 'The Labor Code stipulates, without exception, that the Christmas allowance must be paid by December 15.' If there is an agreement for the process to be phased, 'the last installment must be paid until that deadline,' says Pedro Antunes.
