Pedro Antunes, CCA's Partner and Coordinator of the Labour Department, spoke to the Human Resources magazine about what should happen after the lay-off period. When the calamity situation ends, the exceptional laws whose validity depends on it will naturally cease to be in force. "This means that, on the one hand, there may be a return to the legal regime on certain labour issues, and on the other hand, it is possible that exceptional laws whose validity did not end with the ending of the calamity situation, will enter into force again", reveals Pedro Antunes.
"Another hypothesis is the entry into force of new exceptional legislation, which may in the meantime be published, that is adequate to the challenges of this transition period and that guarantees a satisfactory and gradual return to normality. In my opinion, these times of pandemic may have ‘messed up’ with the legislator in terms of flexibility and safety and health at work, so we can expect a definitive adaptation of the laws to the current needs that are here to last", underlines the lawyer.
