Rita Trabulo speaks to Exame Informática about the Association that manages the .pt domain

Rita Trabulo, CCA ONTIER's Associate Coordinator of the Corporate/M&A Department, in statements to Exame Informática comments the case of the association, non-profit, that exploits the top-level domain in Portugal (.pt). Created in 2013 with the purpose of managing and exploring the addresses ending in .pt, without public tender and benefiting from a maximum investment of 1.9 million euros from the public purse, this association also invested in more than 246 thousand euros in a fund of pensions for 16 employees.

For the lawyer, 'a non-profit designation may mislead laymen by implying that an association can not make a profit. However, this classification only means that the profit is not distributed to its associates'. On the pension fund, he considers that 'it is also permissible for a non-profit association to subscribe pension funds to its employees'.

The fact that the association has as its object the operation (management, operation and maintenance) of a State property may have implications for the application of those profits if it is defined in the agreement which governs that holding, which may involve certain obligations for the Association. Without limits or obligations being defined, the association will be governed by the general rules regarding the application of the positive result of the exercise, 'adds Rita Trabulo.
