Tânia de Almeida Ferreira reflects on municipalities' access to the Tax authorities' database

The recent proposal by the National Association of Portuguese Municipalities (ANMP) aims to allow municipalities direct access to the Tax authorities' (AT) databases to identify attachable assets in cases of enforced recovery. Tax law experts identify the associated risks and the importance of defining clear limits to avoid indiscriminate access to information.

Speaking to the newspaper Público, Tânia de Almeida Ferreira, Partner in the Tax practice at CCA Law Firm, reflects on the need to limit and safeguard access to this data.

"It must be ensured that access is only given to information that is strictly necessary for the exercise of local authorities‘ powers, and for this purpose generalised access to AT databases is not necessary", the CCA partner emphasises, adding that it is "essential to create a set of sanctions for breaches of the duties of access and secrecy, both for the local authority itself and personally for officials who breach the duties to which they are bound".
