Is your company complying with all the environmental obligations regarding waste?

Did you know that by March 31st, you must submit the annual declarations to the Portuguese Environment Agency (APA) regarding the products you produce, the packaging you place on the market, and the amount of waste you generate?

Specifically, if your company has placed certain products on the market (such as electrical and electronic equipment, batteries and accumulators, tires, lubricating oils, vehicles, and end-of-life vehicles), or has marketed any packaged products, it may be subject to the specific waste flow regime, which implies: 
 
✅ Financing and organising waste management, collection and recycling systems;
✅ Annual registration and submission of data into SIRER (Siliamb);
✅ Compliance with European packaging and labelling standards;
✅ New rules on printing receipts and documents, effective from January 2025;
✅ New obligations regarding reusable packaging and deposit and collection systems for beverage packaging, that will come into force during 2025.

The annual data submission includes providing information on the quantity of products and packaging placed on the market in 2024 and the corresponding estimate for 2025.

On the other hand, if your company produces waste that is not collected by the respective municipal or multi-municipal urban waste management system, there may be an additional requirement to fulfill: the submission of the MIRR Declaration, which is essential not only to ensure environmental compliance in waste management, but also to avoid penalties.

It should be reminded that failure to comply with these obligations may result in environmental and economic administrative offences, with fines ranging from €1,700 to €5,000,000, depending on the type and seriousness of the offence, as well as additional penalties, including restricting the company's activity until the situation is rectified.
