The functionalities of the new “Contract Termination Platform” (Ordinance n.º 284/2022), provided in article 138 of Law n.º 16/2022 of August, which ratifies the Electronic Communications Law, were approved.
The functionalities of the new “Contract Termination Platform” (Ordinance n.º 284/2022), provided for in article 138 of Law n.º 16/2022 of August, which ratifies the Electronic Communications Law, were approved.
The new Electronic Communications Law, whose entry took place on November 14, 2022, ensured the transposition into the national legal order of 3 directives, including Diretiva UE 2018/1972 of the European Parliament and of the Council, of December 11, 2018, which establishes the European Electronic Communications Code (Electronic Communications Law), which enshrines, among other aspects, the rights and interests of end users of these services.
It is within this framework, and pursuant to paragraph 5 of article 138 of this Law, that the possibility is established for consumers to exercise their rights of complaint, expiry and termination of contract through a platform created and managed by the Direção-Geral do Consumidor (DGC).
This new online platform will allow consumers to enjoy the following features:
• Formulating requests for information regarding your contractual termination rights and obligations;
• Exercising the right of termination by terminating the contract, although it is still possible to request it in the traditional way;
• Submission of contracts suspension and expiry requests (not yet available on the Platform);
• Exercise the right of contractual termination by resolution (not yet possible on the Platform);
The DGC platform is already available on the Plataforma de Cessação de Contratos, although it does not already have all the features approved in this initial phase.
