The implementation of the Digital Services Act (DSA) marks a significant development in the regulation of digital platforms across the European Union. Designed to foster a safer, fairer, and more transparent online environment, the DSA imposes strict obligations on digital service providers, targeting issues such as content moderation, user safety, and the accountability of very large online platforms like Meta and TikTok.

In an article for Legal Industry Reviews, Rita Serrano, Managing Associate at CCA's Data Privacy and Protection Department, and Ana Beatriz Bravo, Junior Associate at CCA's TMT Department, highlight the European Commission's proactive measures in enforcing the DSA. They discuss the Commission's recent actions against major platforms for failing to comply with the DSA's requirements, particularly in conducting risk assessments and ensuring transparency in content moderation and data practices.

"The failures to complete the assessment and mitigation of risks inherent in the design of Facebook’s algorithm and TikTok’s recommendation system — which led to the recommendation of harmful content to minors — were decisive factors in the EC’s decision," the lawyers emphasise.
